You are not obligated to respond

When you get a ticket in the mail, You should not do anything with it. It is only send to you to see if you will respond. In other words, dupe you into thinking you have to pay the fine. That’s what they really want you to do. All the City wants is you money and they want to do as little at first to try and get it. Just remember you are not obligated to respond to any fine send to you via the mail. In other word just toss it in the trash as it’s not worth the paper it’s printed on.

Register you car in your spouse’s or company name.

I know this sounds a bit shady and drastic, but so isn’t photo radar and traffic cameras. One way, people seem to be avoiding the camera fines is having the car registered under their wife or husband’s name or company name. In Arizona the companies that process the photo tickets have to identify the drive. It is impossible to I identify the driver when it is registered to the company as a company does not have a driving record. If the driver of the car is female and the car is registered to a male the ticket will be void as they cannot adequately identify the driver. In many cases you will receive a letter in the mail letting you know the city or state wants to issue a ticket. They would like you to identify the driver of your vehicle. You are not bound by any law to do so.

Don’t give up the driver.

As said in the last section. You are not bound by any law to give up any information as to who was diving the car. Courts may ask you to give up this information. They may seem very intimidating when they do. The companies that issue the tickets, along with the city are responsible for doing that. If you identify the driver, you are only doing their work. If you think your going to get a ticket in a rental car contact the rental company and let them know they do not have your permission to give out your name. As they are also not bound by any law to do so too.

Process Server will be knocking on your door.

Some websites report that Municipalities only scare you with the idea that a person will be knocking at your door to serve you a photo ticket. In fact that is far from the truth. As someone who has had a run in with a Process Server, I know for a fact that they are out there and come at very strange times. It can be very strange if not scary to have someone knock on your door and ask your last name. Word to the wise, "don’t say anything to someone you don’t know" Sometimes they come up and ask you just your last name, or if this is the "such and such residents." Just say "No" and don’t answer any more questions. Tell them to leave your property. (Hint) They may keep coming back to try and trip you up to just saying your last know or if you know the person in question. Be on the lookout for about 120days. I got a server at my house at 8:30pm on a Sunday. They will come at any time they think they can serve you.

Improper service.

If you feel like you were improperly served for a ticket. You can file a complaint against the Process Server. You can find the form to do so at www.photoradarlaw.com and click under forms. Process Servers are required to server the ticket properly. They singe an affidavit stating the service was completed in the appropriate manner. "ARS22-1513B"

The ticket cannot be left at your doorstep, on your car etc. It must be handed to a legal adult. If the service was done improperly and was said to be served correctly via affidavit the Process Server has just perjured them self. Be prepared to present your case to the court. Have a witness that can confirm your whereabouts at the time of service. Do not be afraid to contact a local Attorney.

I have got to be the most laid back person in the world. Nothing gets under my skin all that often. But today I was reading at the local Arizona website azcentral.com. Today on there was news of the state adding what could be up to 200 photo speed cameras state wide. At the cost of 20million big ones! Here is how messed up it all is… The state will only fine you $165 for being caught by a speed camera and that's it. NO recourse from motor vehicles, or insurance points. So what does that mean? IF you are rich you can do what ever you want and pay the fines and not worry about a thing or having your drivers licence suspended. that's just one of the arguments raised about the new cameras. Arizona is selling this to the public as a way to safe lives and make the roads safer. Come on that's a bunch of BS. If no one is getting any added motor vehicle penalties, like loss of driving privileges or insurance points. Than what are the new cameras really for??? The answer is MONEY!!! yup cold hard cash.

Arizona is in so much debt they are looking at this investment of 20million big ones as a way to make money. Its kinda that cut and dry. rather than dump 20mill on more cops the ROI on the new cameras could be staggering. Some people say they have a quick solution "DONT SPEED and let them eat their 20million invested in photo cameras." If it were like that than don't buy gas and prices would fall or kinda like whats happening now with big SUV's know one is buying them and the prices are falling.

The truth is even good people speed without even knowing it from time to time and when they do, the state of Arizona will be there to give you a ticket. At least that's what there banking on.

Arizona really wants you to speed because it makes them $$$$money$$$$. They don't want to save your life or make the roads safer. If that was the case they would fix all pot holes and bad roads so you don't get a flat and spin out, killing yourself or someone else.

Arizona right now is expanding some of its freeways. why are they doing this. that's simple to fit more cars on the roads and free up traffic jams. What happens here is when there is more room to drive traffic moves faster and that = $$$ a better chance for these speed cameras to snap your picture and send you a nice fine in the mail. Lets face it they "aint makin money" if your going slow in traffic. How ironic is it that one of the spots of the freeway expansion is just before a established speed camera? I tell you what. It's a very smart move on their part. kinda Vegas like. In the way that Las Vegas is designed to take your money. Crazy if you think about it. The State is setting a trap right in front of of the eyes on Arizonans. I would expect that in other spots were freeway expansion is being done a speed camera will be close by.

IF this does happen and Arizona Adds 200 speed camera this will be an unprecedented display to big brothers ever growing power to watch listen and control you. I don't know but fascism might be right around the corner if we don't do anything to stop local governments from adding more ways to control you. think about that.

It seems common place these days to see flashing bulbs on the streets. More and more each day cities, towns, and states are adding what most feel is an unfair weapon to control drivers. Photo enforcement cameras let the governing bodies keep an eye on drivers without have to witness it first hand. As much as i feel we should all fight governments who install more ways to watch over you and control you. Photo radar, speed camera, red light cameras (or what ever you like to call it) are here to stay. As its to much of a cash cow for local municipalities.

"What can i expect if I'm caught by photo enforcement?" This is what you can expect. In a few day or weeks the OWNER of the vehicle that was used in the so called "offence" will be mailed out a fine (fine rage from state to state). Along with the fine and description of the offence a picture of your vehicle and (some states) a picture of the driver.

In Arizona there is also a website address in you mailed ticket. What ever you do DO NOT VIST THAT SITE! They will use this as a means of adaquetly serving you the ticket. When you get your ticket in the mail "I would" (this is up to you) just through it away. After a while a the state will send a server out to physically serve you the ticket. So after you toss out the fine in the trash, be on the look out for people knocking at your door. I would advise you to answer the door. You should know right away if you know the person who is knocking on you door. The server will ask you if you are such and such (even just a last name is good enough for them) or something along those lines. Your best bet is to play dumb! Tell them you are not who they are looking for and you don't know them. Don't tell them they use to live there. Act like you have never heard who you are looking for make it short don't answer any more question and close the door in there face. Yeah its kinda rude, but so isn't the ticket they want to give you.

After 120 day in Arizona photo tickets drop off and your in the clear "What if you want to fight it?" You have a bunch of outs here too. If you choose to fight the ticket. You can expect a bit of a drive in some areas. As the local court in most places is not close. When you get to the court house you will go in front to the judge or magistrate. Tell the judge why you are fighting the ticket. Your reasons can range from, lack off proof you were the one driving the vehicle. Or the picture of the driver is not you or unclear as to who it was. The judge will most likely ask "who was driving" Your response should be "I let other people drive my vehicle often and I can not recall who the driver was at that particular time, nor do i know who it is inthe picture." If that fails Ask the judge you would like to face your accuser. (I think this is applies to criminal cases.) As that is your constitutional right. In this case the accuser is a camera. Your case should be finished after that comment. A camera is not a certifiable witness of the event. You can also ask to have the camera tested to make sure it was working correctly at the time the picture was taken.

In some states fines like these have been found to be unconstitutional. In Minnesota the Supreme Court struck down red light cameras. One of the biggest parts of their ruling was aimed at the heart of every photo enforcement ordinance in the USA. This is called "Rebutable Presumption." The ruling was that assuming the owner was the driver illuminates the presumption of innocents and that went against the criminal procedure.

Looks like we have another city in the USA were, red light cameras are not doing any good. In Chandler Arizona 60 plus red light offenders are caught everyday well turns out only about 17% of them are being paid. Oops…

In a half years time Chandler was expecting to rake in over 2million dollars for the red-light program but only brought in just under $300,000. Most of that money will be sent to the company that runs them as they have a contract stating they will be paid a percentage of the tickets issued.

What’s happening here, is people are just ignoring the fines sent to them in the mail. After some time a process server will be knocking at your door to serve you the ticket. Well if you can dodge him for 120 days the fine drops off because they were unable to serve you. Looks like this system is really working ;). Another reason showing photo radar and red light cameras don’t work.
